Acceptance of terms of use

These "Terms of Use" govern your association with and use of Bookelphia website, content and services hereinafter referred to as "Service". The Service is owned and operated in the name of Bookelphia (hereinafter referred to as "Bookelphia") owned by Amreet Innovations Ltd and is offered to you ("You", or "Member") as per your agreement with and acceptance of the Terms of Use.

These Terms of Use are an ongoing contract between you and Bookelphia and apply to your use of the Bookelphia website, contents, materials and service. These Terms of Use affect your rights and you should read them carefully.

Bookelphia reserves the right, without limitation, with or without intimation to you, to change these Terms of Use at its sole and absolute discretion. At any point in time, the applicable and most recent version of the Terms of Use are provided in this section and a link to the same is available on the bottom portion of the Bookelphia.com homepage.

The most current version of the Terms of Use will supersede all previous versions. Your use of the Bookelphia Website or continued use of our service after changes are made to the Terms of Use imply an agreement on your part to abide by the modified Terms of Use.

By browsing the Bookelphia website, you accept and agree to abide by these Terms of Use. If you do not agree to these Terms of Use, we advise you not to use the Bookelphia website.

By ticking the box titled "I Have Read and Accept the Terms of Use" as part of the registration process, Members accept all clauses and items in the Terms of Use and agree to abide by and be legally bound by it.

Your information is safe with us. We take all necessary precautions to protect your privacy. We are fiercely and jealously protective about our information and do not share it with third parties for any purpose whatsoever, unless it is mandated by law for specific purposes. Intellectual Property Copyright

Bookelphia does not own the copyrights of books shared on the network. It is only intended to be a network of people who are enthusiastic about reading and wish to share their books with other members of the network. We do not make any claim regarding the ownership or copyright of the books and / or content shared by the members of the network.

Trademarks and Copyrights

All content included on the Bookelphia website and delivered to subscribers as part of the service, including - but not limited to - book(s), images, text, logos, pictures, clips, downloads, etc , is the property of Amreet Innovations Ltd or its associates. The content is protected by the Indian and international copyright laws.

You agree not to process, decompile, manipulate, use or affect the content or services on/through Bookelphia website and/or its servers, user interface, and information database in any manner that affects the utility or experience of the website and its services.

Bookelphia promotes the use of book(s) and other material shared with you for solely for your personal reading / consumption and non-commercial use. Bookelphia reserves the right to terminate your membership / use of the website, content and services if Bookelphia, at its sole and absolute discretion, believes that you are in violation - in words, action, or spirit - of this clause in our agreement. Such violations include renting, sharing, photo-copying or other unauthorized use of books and materials received by you through Bookelphia.

Bookelphia is a trademark of Amreet Innovations Ltd. The Bookelphia website viz. Bookelphia.com is owned by Amreet Innovations Ltd and all its associated content, including but not limited to its logo(s), graphics, taglines, website/page headers, button icons, scripts and service names constitute the trade property of Amreet Innovations Ltd. None of these may be alluded to, used or reproduced by anyone without prior written approval from Amreet Innovations Ltd. The trade properties associated with Bookelphia may not be used in connection with any product, content, or service that is not affiliated with Bookelphia.

Other trademarks that appear or are mentioned on the Bookelphia website and/or its material / content are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Bookelphia. Any images of books, persons, places and others shown / shared on the Bookelphia website and materials are not meant to imply and endorsement of Bookelphia and its services in any manner whatsoever, unless specifically indicated.

Disclaimers of warranties and limitations on liabilities

Our website, including its content and associated services, are provided on an ‘As-Is’ basis without any warranties or liabilities, specified or implied. In addition, we assume no liability or responsibility for

Any errors or omissions in the content of Bookelphia website or other material / merchandise associated with our interactions with you
Any failures, delays, or interruptions in the delivery or return of book(s), or any other content within our network
Any losses or damages arising from the use of books, materials and content shared through or provided on the Bookelphia platform and its services
Any losses, damages or errors arising out of your use of websites or links connecting you to other websites or those connecting other websites to us. We are not responsible for your interactions with those websites and you do it at your sole discretion.

We reserve the right to ship books and other material at our sole and absolute discretion. While we would strive to provide you up-to-date information regarding the status of the delivery, the said information would be provided only on a best-effort basis and may not be accurate or current.

We disclaim all representations and warranties regarding the sharing and use of books, materials and other content through Bookelphia, including - though not limited to

Warranties of merchantability / tradability
Fitness for any specific purpose of use
Non-infringement of copyright

Under no circumstances shall Bookelphia, its promoters, directors, officers and employees and other associated personnel be liable (individually, jointly or severally) to you for any direct, indirect, circumstantial, or consequential damages of any kind whatsoever resulting from loss of application, reputation, information, or profits. This shall apply whether or not we have advised you of the possibility of the damage. In case any appropriate authority holds any portion of this section to be unenforceable or unlawful, then our liability will be limited only to the extent permitted by applicable law.

The maximum liability of Bookelphia, whatsoever, under any circumstances would be limited to the fair market price of the book or material related to the specific transaction under consideration. Specifically in case of books - whether stolen, lost, torn or unacceptable to the owner / sharer of the book in any manner - Bookelphia will only be liable to replace the copy of the book with a fresh one. In the event the book is not procurable with reasonable effort, Bookelphia will be liable for the procurement price of the book - as mutually agreed upon between the owner and Bookelphia - without any cost escalation / adjustment whatsoever to the procurement price.

Communications

You consent to receive information and material from us and our affiliates from time to time. These may be sent to you in electronic, physical or other forms at the discretion of Bookelphia to promote its services and those of its affiliates / partners. The communications may include information / notices related to your account, your transactions and our service including featured books, reading / viewing material, and other offerings.

Your conduct on website and limitation of use

You agree

Not to share, post, transmit or refer to any material that you are not authorized to completely or partially use / share / transmit or that is offensive, inappropriate or restricted for sharing on public / private platforms and forums
Not to impersonate others or use the website for unlawful purpose
Not to upload, post, e-mail or transmit any material that contains software viruses, malware or any other computer code or programs designed / leading to interruption or limiting of the functionality of equipment and services associated with Bookelphia or Amreet Innovations Ltd.
Not to interfere with servers, service provides or networks connected to Bookelphia

Use of Information shared with us

Amreet Innovations Ltd., is free to use any content – including but not limited to reviews, comments, information, ideas, images, ratings, or any other material contained in any communication you may send to Bookelphia ("Content"). The Content may be used by us without explicit approval, compensation, or acknowledgement for any purpose whatsoever including, but not limited to, designing, developing, preparing, sharing and marketing products and editing, creating, modifying or improving the Bookelphia website or dassociated materials.

By engaging with us or sharing any Content with us you agree to give us irrevocable, uninterrupted, non-exclusive, royalty-free license and right to display, use, reproduce or modify the Content on our website and as part of our services. In addition, for all Content shared by you with us, you wave any claim against Bookelphia and its affiliates regarding the use of such materials and ideas.

You acknowledge that Bookelphia is not a publishing / content creation platform. We do not solicit or accept materials or ideas for use or publication. Bookelphia does not accept responsibility for proximity to, or similarity of, your content with that shared by others on the date of your sharing or on any subsequent date. In the event that you wish to send any unsolicited Content with us, you do so at your own discretion along with the understanding that no consideration of any sort will be provided to you.

Damaged Books

Your association with Bookelphia as a member of the book sharing network places the responsibility on you to take care of books you receive through, or share with, the network.

For books that you received from the network

Please ensure that you return them in as good a condition as you receive them in
Please return them in a reasonable / timely manner to the network so that we may share more books with you and other users may benefit from the books shared
For any damage caused to the books while they are shared with you, Bookelphia reserves the right – at its sole and absolute discretion – to charge you for the cost / replacement of the book.

For books that you share with the network

Please refrain from sharing books that are not maintained well or are damaged, torn, etc
Please also do not share books that you have special / emotional association with. While we take all possible precaution while handling books in the network, we cannot guarantee that the books will be retained in absolutely the same condition that you shipped them in.

Some simple Do's and Don'ts

For Book Owners

Please list your owned books only, for sharing.
The books should be currently kept and available at your place of residence or office, whichever is your pick up location. You may choose to have both.
The books added to your shelf for sharing should be in good and maintained condition for others to read.
Each book borrowed from your shelf will add INR 30/- to your wallet.
The book borrowed from you, if found illegible or damaged, we may decide not to share it with the Reader. In such a case, the book will be returned to you within 4 working days and the credit made to your wallet will be reversed.
Bookelphia will take care of the book whilst in transit and circulation. In case of damage to the book, we will either place or reimburse the cost. Minor damages will be repaired at our cost.
Do not share copies of books that you are emotionally attached to. In case of an unfortunate event of loss, we can only replace with a new copy and not bring back the same old book to you.
On request for a book, kindly respond at the earliest. We send book request to you by mail, whatsapp and sms. If we don’t hear within 4 hours from last sent message to you, we will check with any other owner who has a copy of the same book. Once the other owner has confirmed, we will not be able to pick from you.
When confirming the book pick up, please ensure you have checked that the book is available. Should we come for pick up and book is not found, it would lead to deduction of INR 30/- from your wallet. However the biggest disappointment is to the Reader who will not get the book in time.
If you are going out on holiday or your books are temporarily unavailable, please let us know in advance on email/sms/ whatsapp. We can temporarily hide them in system. Similarly inform us when you are back and we will show them up again.

For Book Readers / Borrowers

The books sent to you for reading are pre owned books.
Please take utmost care of books so as not to damage them.
The book will be delivered to you in a book bag. Please use the bag to keep it safe and return the book in same bag.
The book that you receive may not be the same copy as you see on the website.
It is likely that we may not be able to send you the book, even if it is showing as available in the system. Every book is checked before sharing. If we see that the book is not in good condition or illegible, we will return it to the owner. In such a case we will not be able to send you the book immediately. We want you to enjoy the reading and not struggle. Your request will be kept in wish list. We will inform you as and when another copy of the book is available.
You can order multiple books. All books selected by you for reading will be maintained in your wish list. We will send them one by one as per the earliest available. In case of more than two books from your wish list available simultaneously, we will ask your preference for reading.
Do not share the book with any other member outside your home.
There is no time limit defined to return the book. However we urge you to return the book as you finish reading because somebody else may be waiting to read the book.
While returning, please keep the book ready in the same bag in which it was delivered. For loss of bag, we will have to deduct INR 30/- from your wallet.
If you are not available at confirmed delivery or pick up time, immediately send a mail or sms/ watsapp message on 9987759025. It is important because every delivery and pick up costs us money (not mentioning fuel and the environmental aspects). Alternatively, you can tell us if you wish it to be delivered or returned from your neighbour’s place or security, if you have an arrangement.
